This MCLAREN EXPERIENCE GIVEAWAY (“Giveaway”) is sponsored by DEWALT, a Division of Stanley Black & Decker Canada Corporation, 6275 Millcreek Drive, Mississauga ON, L5N 7K6 (“Sponsor”). This giveaway will be held at the Edmonton EXPO Centre - 7515 118 Ave NW, Edmonton, AB T5B 0J2. The entry period is from September 23, 2023 9:00 AM Mountain Time (“MT”) through September 24 2023, 5:00 PM MT while the DEWALT/STANLEY/IRWIN Booth (#930) is open (“Entry Period”). Sponsor will be the official timekeeper of this Giveaway. Each entrant understands that they are providing their information to Sponsor and the information provided will be used in accordance with Sponsor’s privacy policy (https://www.stanleyblackanddecker.com/privacy-policy). Should there be conflict between Sponsor’s privacy policy and these Official Rules, these Official Rules shall govern. Any personally identifiable information collected during an entrant's entry in this Giveaway will be collected by Sponsor or its designee and used by Sponsor and/or its designees for purposes of the proper administration, fulfillment, publicizing and promotion of this Giveaway as described in these Official Rules, as stated in Sponsor’s privacy policy or as otherwise expressly consented to by entrant during any separate opt-in opportunity provided to entrant during this Giveaway. By entering this Giveaway, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and decisions of Sponsor which shall be final and legally binding in all respects. If an entrant does not fully agree to the terms of the Privacy Policy, such entrant should not enter this Giveaway. Limit of two (2) Entries per person; one (1) Winner to be declared and one (1) prize to be awarded. The Giveaway is in no way sponsored, endorsed, administered by, or associated with Canadian Tire Corporation, Limited (“Canadian Tire”). Any questions, comments or complaints must be directed to the Sponsor, and not to Canadian Tire.


1. ELIGIBILITY: This Giveaway is open only to Canadian Tire Store Owners (“Canadian Tire Associate Dealers”) who are legal residents in Canada, and have reached the age of majority or older in their Province or Territory of residence at the time of entry. Employees, their immediate families (spouse, domestic partner, children, siblings, parents, grandparents, grandchildren and step family members) and/or people living in the same household (related or not) of Sponsor, Stanley Black & Decker Canada Corporation, entities and persons associated with the promotion, fulfillment, or administration of this Giveaway, and of any of their respective affiliates (individually and collectively, “Giveaway Entities”) are not eligible to enter. Eligibility is subject to all federal, provincial, territorial and local laws and regulations, as well as the rules adopted in view of said laws. Void where prohibited by law.


2. HOW TO ENTER: Entrants must enter this Giveaway, during the Entry Period only, by any of the below entry methods as follows:

BOOTH ENTRY:
Canadian Tire Associate Dealers must go to the respective DEWALT/STANLEY/IRWIN Booth (#930):
(A) obtain a Passport Card (“Passport”) from an employee in the booth;
(B) visit a minimum of one (1) of three (3) stations in the booth to get a stamp or signature on your Passport
(C) complete the passport with your First Name, Last Name, Email Address and Phone Number
(D) drop your Passport in a ballot box located in the booth.

EMAIL SUBSCRIPTION ENTRY:
Canadian Tire Associate Dealers can receive one (1) additional entry by checking the box on the Passport to receive emails from DEWALT® with news, special offers, promotions and other information.

All entrants must enter this Giveaway during the Entry Period. Entrants must legibly and fully complete the entry form made available by Sponsor. All information requested on the entry form is required to be completed by entrants to enter this Giveaway. Each fully completed, legible and valid entry form received by Sponsor during the Entry Period will qualify as one (1) “Entry” and will be entered in the random drawing for a chance to win the prize. The maximum number of Entries each entrant can enter in this Giveaway is two (2). Sponsor will not be responsible for any lost, late, incomplete, incorrect, illegible, damaged, invalid, unintelligible, or misdirected entries and such invalidated entries will be disqualified and not entered in the random drawing. Tampering with the entry process or operation of this Giveaway is prohibited and any entries deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. Any attempt by any entrant to enter by using multiple/different email addresses, phone numbers, identities, or any other method will be voided, and entrant may be disqualified at Sponsor’s sole and absolute discretion. In case of a dispute over the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “Authorized account holder” is defined as the natural person assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Multiple entrants are not permitted to share the same entry form, email address, cell phone number, identification or other information used in connection with entering this Giveaway. All Entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Sponsor reserves the right to contact any entrant whose information is submitted as part of entry in this Giveaway. Entrants must enter this Giveaway on behalf of themselves only, as individuals, and not on behalf of any business, legal entity, organization, or other person.

3. RANDOM DRAWING: The random drawing will be held on or about 5:15 p.m. MT on September 24, 2023. The one (1) Entry drawn will be declared the potential “Winner”. Entrants are not required to be present to win. Odds of winning depend on the total number of valid Entries received by Sponsor during the Entry Period. The potential Winner must comply with all terms and conditions of these Official Rules and winning the prize is contingent upon fulfilling all such requirements. AN ENTRANT IS NOT THE WINNER OF THE PRIZE UNTIL ENTRANT'S ELIGIBILITY AND QUALIFICATIONS HAVE BEEN VERIFIED AND ENTRANT HAS BEEN ADVISED BY SPONSOR THAT SUCH VERIFICATION IS COMPLETE.

4. NOTIFICATION / PRIZE ACCEPTANCE: The potential Winners will be notified by Sponsor via email or phone number provided by the potential Winner within five (5) days after the drawing is held. Within five (5) days of the first notification attempt by SPONSOR, the potential Winner must: (A) return to SPONSOR a completed and personally signed Declaration of Eligibility and Liability/Publicity Release (“Declaration and Release”); and (B) correctly answer a time-limited, mathematical skills-based question (to be administered by telephone or email) without mechanical or other assistance -- FAILURE TO DO SO WILL RESULT IN FORFEITURE OF THE PRIZE. In addition, the potential Prize Winner and travel companion must consent to take, and must successfully pass, a background-check or they will be disqualified from receiving the Prize. Sponsor shall have no liability for any notification that is not received by the potential Winner for any reason. If the potential Winner does not respond to notification and accept the prize as required herein or if prize notification is returned as unclaimed or undeliverable, such potential Winner will be disqualified and forfeit prize. If the potential Winner is found to be ineligible, has not complied with these Official Rules or declines the prize such potential Winner will be disqualified and forfeit prize. If the potential Winner is disqualified or forfeits prize, Sponsor may, but shall not be required to, select an alternate potential Winner from amongst all remaining eligible Entries.

5. PRIZE: The Prize is comprised of the following:

  • A trip for the winner and one guest for a four (4) day trip to the AWS GRAND PRIX DU CANADA 2024 in Montreal, Quebec, at the Gilles Villeneuve circuit. The Winner’s guest can be a minor under the age of majority. The Prize package consists of:
    • Two (2) Grandstand tickets to watch the practice and qualifying races on June 7, 8 and 9 2024
    • Round trip, coach air transportation for two from a major commercial airport near the winner’s home (chosen at Sponsor’s sole discretion) to a major commercial airport near Montreal, Quebec, departing on or about June 6 2024 and returning on or about June 9 2024. Sponsor reserves the right to provide ground transportation in lieu of air transportation if the winner resides within two hundred (200) miles of Montreal, Quebec.
    • Three nights lodging (standard accommodations, double occupancy). Winner will be required to provide a credit card to hotel to cover incidentals which are not included in the prize.
    • Credit for travel expenses not included herein, including but not limited to airline baggage fees, gratuities, meals, airport fees, parking fees, personal charges at the hotel, and any other incidental costs or expenses related to participation in this prize. The approximate retail value (“ARV”) of transportation, hotel accommodations and travel expenses is $12,000 CAD.

Travel must take place on the dates set forth above. If the winner is unable or unwilling to travel on the dates specified, the prize will be forfeited and may be awarded to an alternate winner. All travel included in the prize is subject to availability and restrictions. Winner and travel guest must travel on same itinerary.

The prize is transferable at the Sponsors sole and absolute discretion. If the Winner is unable to attend the race, the Winner can transfer the Prize to another Canadian Tire Associate dealer or employee (and one guest). The prize is only transferable to a Canadian Tire Associate Dealer or employee. Sponsor must be notified that the Winner will be transferring the prize. Sponsor will reject the transfer if the transferee is not a Canadian Tire Associate Dealer. Proof of Canadian Tire employment will be required. Notification of transfer of prize should be directed to Andrew Cinerari (andrew.cinerari@sbdinc.com). Sponsor reserves the right, in its sole and absolute discretion, to substitute the prize for one of equal or greater value, for any reason. The prize ARV represents Sponsor’s good faith determination, is final and binding and cannot be challenged or appealed. The total Prize ARV is $12,000 CAD. All income and other taxes (federal, provincial, territorial and local) on the prize are the sole responsibility of the Winner.

6. ENTRY CONDITIONS AND RELEASES: BY ENTERING THIS GIVEAWAY, EACH ENTRANT AGREES for entrant and for entrant’s heirs, executors, administrators, representatives, insurers and assigns: (A) to release and hold harmless Sponsor, Giveaway prize supplier(s), any other entity or organization responsible for sponsoring, fulfilling the prize, administering, advertising and/or promoting this Giveaway, and each of their respective past and present officers, directors, employees, agents, representatives, designees, owners, shareholders, parent companies, subsidiaries and affiliates (individually and collectively, “Released Parties”) from and against any and all claims, expenses, liabilities, personal injury, death, illness, property loss, litigation or damages of any kind to persons and/or property (including but not limited to invasion of privacy under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory, defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights) that may occur, directly or indirectly, whether caused by negligence or not, arising out of such entrant’s entry in this Giveaway and/or such entrant’s acceptance, possession, use and/or misuse of the prize including but not limited to any travel or activity related to collection of the prize; (B) to indemnify, defend and hold harmless Released Parties from and against any and all claims, expenses and/or liabilities (including reasonable attorneys fees) arising out of or relating to such entrant’s entry in this Giveaway and/or entrant’s acceptance, use and/or misuse of prize; (C) to be bound by these Official Rules, to waive any right to claim any ambiguity or error therein or in this Giveaway itself, and to be bound by all decisions of Sponsor which are final and binding in all respects; and (D) Released Parties are not responsible or liable for any error, omission, interruption, defects, delay, theft, destruction or unauthorized access to or alteration of entries or for any malfunctions of the computer Internet system, computer equipment, software, the random drawing tumbler, or any combination thereof. Sponsor shall have no responsibility for any failed attempts to contact the potential Winner. Further, Released Parties are not responsible for, and each entrant hereby releases the Released Parties from, any claims arising from: (i) lost, late, illegible, mutilated, misdirected, damaged, corrupted, inaccessible, inaccurate or incomplete entries, entries not received by the time designated for the Entry Period of this Giveaway, or for any electronic or human error that may occur in the processing of Entries or in the administration of this Giveaway; (ii) technical failures of any kind, including but not limited to the malfunctions or interruptions of any computer, equipment, cable, network, hardware or software, programing, or failure of an email on account of technical problems or traffic congestion on the Internet; (iii) the unavailability or inaccessibility of any transmissions of cellular phone and/or text services; (iv) unauthorized human intervention in the entry process or technical or human error which may occur in the administration of or processing entries in this Giveaway or in the random drawing;(v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s entry in this Giveaway; and (vi) theft, tampering, destruction, or unauthorized access to, or alteration of entries. Sponsor is not responsible for any electronic or typographical errors in the printing, advertisement or reproduction of these Official Rules, in any advertisement or promotional materials related to this Giveaway (print or online), and/or in the administration of this Giveaway, depiction of the prize or announcement of the Winner.

 

7. PUBLICITY RELEASE: Acceptance of the prize constitutes the Winner's permission for Sponsor to use the Winner's name, photograph, video, image, likeness, voice, biographical information, statements, testimonial (in whole or part), prize information and address (city, province or territory) (collectively, "Attributes") for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation or authorization (except where prohibited by law) and the Winner releases Sponsor and/or its designees from all claims arising out of the use of such Attributes.

8. DISQUALIFICATION/FORCE MAJEURE. Sponsor reserves the right to modify, extend or terminate this Giveaway if it determines, in its sole discretion, that this Giveaway is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of this Giveaway as contemplated herein. If an insufficient number of eligible Entries are received and/or Sponsor is prevented from awarding the prize or continuing with this Giveaway as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, or any federal, provincial, territorial or local government law, order, or regulation, public health crisis, pandemic (e.g. Coronavirus/Covid-19), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, extend or terminate this Giveaway. If this Giveaway is terminated before the designated end date, Sponsor will (if possible) select the potential Winners in a random drawing from all eligible, non-suspect Entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

9. DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or the prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys' or legal fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.

10. OFFICIAL RULES: To obtain these Official Rules, send a self-addressed envelope to DEWALT, 6275 MILLCREEK DRIVE, MISSISSAUGA ON L5N 7K6, Attn.: C. Gutteridge, MCLAREN EXPERIENCE GIVEAWAY. All such requests must be received by June 30, 2024.
